Colorado Coverage Disclosure & Insurer Duties

Colorado has a specific statutory disclosure framework for identifying liability policies and limits relevant to a pending or prospective claim. Under C.R.S. § 10-3-1117, an insurer that provides or may provide liability coverage must respond to a qualifying written claimant request within 30 days with the policy information required by the statute, including relevant policy documents and coverage information.

  • Send a written disclosure request that complies with the statute and preserve proof of receipt.
  • Identify each known policy that provides or may provide liability coverage, including potentially relevant umbrella or excess coverage.
  • Distinguish disclosure of policy information from unresolved coverage defenses or disputes.
  • Preserve the insurer’s response, delivery records and any dispute over timeliness or completeness.

If the insurer violates the disclosure requirement, § 10-3-1117(3) provides $100 per day beginning on and including the 31st day after receipt of the written request, continuing until the required information is provided, together with attorney fees and costs incurred to enforce the statutory remedy.

Colorado appellate law on the limitations period requires particular care. Reynolds v. Great Northern Insurance Co., 2023 COA 77, treated the remedy as a statutory penalty subject to a one-year limitation. In Weatherill v. State Farm, 2026 COA 11, a different division declined to follow Reynolds, held that the remedy is not a penalty for limitations purposes, and applied the two-year period in C.R.S. § 13-80-102(1)(i). Bohanan v. Esurance Property & Casualty Insurance Co., 2026 COA 6, separately enforced the $100-per-day measure for delayed production of a relevant policy. Current appellate and Supreme Court status should therefore be checked before relying on a limitations calculation.
