Colorado Government Vehicle Crashes & Public Entity Claims

Claims involving state, county, city, school, transit, police or other public vehicles require analysis under the Colorado Governmental Immunity Act, including waiver, notice, timing and liability-limit issues.

  • Identify the public entity, employee, vehicle ownership and course of employment.
  • Determine whether a statutory waiver applies to operation of the vehicle.
  • Calendar the CGIA notice and lawsuit deadlines separately.
  • Preserve public records, fleet data, dispatch, body-camera, dash-camera and maintenance evidence.

The CGIA includes a waiver for injuries resulting from operation of a motor vehicle owned or leased by a public entity and operated by a public employee in the course of employment, subject to statutory exceptions and current law.
