Colorado Uninsured & Underinsured Motorist Coverage

Colorado UM/UIM coverage is governed principally by C.R.S. § 10-4-609. Insurers must offer UM/UIM coverage, subject to statutory selection or rejection rules, and the analysis should address insured status, limits, offsets, stacking and preservation of first-party rights.

  • Obtain declarations, endorsements and UM/UIM selection or rejection documents.
  • Identify every policy under which the injured person may qualify as an insured.
  • Review liability settlements and any subrogation or consent issues before release.
  • Analyze stacking and anti-duplication provisions under current Colorado law.
