Delaware Settlement, Release & UIM Settlement Notice
Settlement should come only after responsible parties, applicable liability coverage, PIP, UM/UIM rights, damages, liens and reimbursement interests have been identified. Delaware also provides a statutory UIM settlement-notice process when a liability settlement will exhaust applicable liability limits.
- Identify every person and entity being released.
- Review general-release, indemnity, hold-harmless, confidentiality and attorney-fee provisions.
- Provide the UIM carrier the settlement offer, proposed release and required policy information when § 3902A applies.
- Track the carrier’s 60-day response period and preserve proof of notice.
- Resolve PIP, hospital-lien, reimbursement and subrogation interests before distribution.
