Florida Government Vehicle Crashes, Sovereign-Immunity Notice & Liability Caps
Florida Statute § 768.28 provides a limited waiver of sovereign immunity for tort claims against the State and its agencies and subdivisions. The statutory recovery limits are generally $200,000 per person and $300,000 per incident, subject to the statute’s exceptions and claims-bill process.
- Written presentment is generally required within three years after accrual to the appropriate agency and, except for claims against a municipality, county or Florida Space Authority, also to the Department of Financial Services.
- Identify the governmental entity and employee’s scope of employment before serving notice.
- Review sovereign-immunity defenses, statutory caps, insurance and any applicable claims-bill procedure.
- Preserve vehicle, dispatch, video and governmental records immediately.
