Florida Uninsured & Underinsured Motorist Coverage

Florida Statute § 627.727 requires UM/UIM coverage when a motor-vehicle liability policy provides bodily-injury liability coverage, unless the named insured rejects UM coverage in writing or affirmatively selects lower limits as permitted by statute.

  • First determine whether the policy actually provides bodily-injury liability coverage.
  • Obtain the UM/UIM selection or rejection form and verify the limits elected.
  • Identify all persons who qualify as insureds under each potentially applicable policy.
  • Review stacking or nonstacking elections, settlement, subrogation and policy-priority provisions before closing the liability claim.
