Kansas Stacking & Multiple Insurance Policies

Kansas expressly restricts stacking of UM/UIM coverage. Under K.S.A. 40-284(d), total available limits cannot exceed the highest limit of any single applicable policy, regardless of the number of policies, insured persons, claims, vehicles or premiums involved.

  • Identify every potentially applicable policy before applying the anti-stacking rule.
  • Determine the highest single applicable UM/UIM limit.
  • Review policy priority provisions and insured status separately from the limit cap.
  • Do not assume multiple vehicles or premiums create additive limits.
