Kentucky Crash Damages & No-Fault Tort Threshold
Kentucky’s Motor Vehicle Reparations Act limits tort recovery for noneconomic detriment unless the statutory threshold is satisfied or the claimant has rejected the tort limitations. The threshold is met when payable medical expense exceeds $1,000 or when the injury includes specified categories such as permanent disfigurement, fracture, loss of a body member, permanent injury within reasonable medical probability, permanent loss of bodily function, or death.

- Document the medical-expense threshold and any independently qualifying injury category.
- Separate BRB-paid economic losses from recoverable tort damages.
