Louisiana Uninsured & Underinsured Motorist Coverage
Louisiana R.S. 22:1295 generally provides UM/UIM bodily-injury coverage in an automobile liability policy at not less than the policy’s bodily-injury liability limits unless the named insured properly rejects coverage, selects lower limits, or selects economic-only UM coverage on the form prescribed by the Commissioner of Insurance.
- Obtain the declarations page and the prescribed UM selection/rejection form.
- A properly completed and signed form creates a rebuttable presumption of knowing rejection or modification; the statutory form and the insured’s intent matter.
- Economic-only UM excludes noneconomic loss such as pain and suffering but preserves covered economic losses.
- Review insured status, hit-and-run proof, settlement, subrogation and priority provisions before closing the liability claim.
