Mississippi Government Vehicle Crashes, MTCA Notice & Liability Caps
Claims against Mississippi governmental entities are governed by the Mississippi Tort Claims Act. Under Miss. Code § 11-46-11, a claimant generally must serve a notice of claim at least 90 days before filing suit. MTCA actions generally must be commenced within one year, subject to the statute’s tolling provisions after proper notice.

- Serve notice within the applicable one-year period and calendar the statutory tolling and post-denial periods.
- Review immunity provisions, statutory liability caps and employee-scope issues separately.
- Preserve governmental vehicle, dispatch, video and maintenance records immediately.
