North Dakota Uninsured & Underinsured Motorist Coverage

North Dakota requires uninsured motorist coverage and underinsured motorist coverage on covered motor vehicles, subject to the statutory scheme and policy terms. The Insurance Department identifies minimum UM limits of $25,000 per person/$50,000 per accident, and UIM coverage must be equal to the UM coverage. Higher limits may be available under the policy.

  • Obtain the declarations page and all UM/UIM endorsements for every potentially applicable policy.
  • Identify every person who qualifies as an insured under each policy, including household and occupancy-based coverage where applicable.
  • Analyze offsets, exclusions, priority, subrogation and settlement-consent provisions before resolving the liability claim.
  • Do not execute a liability release until its effect on first-party UM/UIM rights has been evaluated.
