New Mexico Rideshare & Transportation Network Coverage
New Mexico rideshare insurance changes with app status. Under Section 65-7-8 NMSA 1978, a transportation-network driver who is logged in and available for requests but not engaged in a prearranged ride must have primary liability coverage of at least $50,000 per person, $100,000 per incident and $25,000 for property damage, together with UM/UIM coverage to the extent required by Section 66-5-301. During a prearranged ride, the required primary liability coverage is at least $1 million, again with UM/UIM coverage to the extent required by Section 66-5-301.
- Preserve app-status, trip and GPS records.
- Obtain the driver’s personal policy and the transportation-network policy.
- Review personal-policy exclusions and rideshare endorsements.
- Request the precise log-on and log-off times and all TNC coverage, exclusions and limits required to be disclosed in a claims coverage investigation under Section 65-7-10.
