Nevada Comparative Negligence & Crash Liability

Nevada uses modified comparative negligence under NRS 41.141. A claimant’s damages may be reduced by the claimant’s percentage of negligence, and recovery is barred when the claimant’s negligence is greater than the negligence of the responsible tortfeasor or combined tortfeasors against whom recovery is sought.

  • Identify every potentially responsible driver, owner, employer, public entity and other actor.
  • Preserve physical, electronic and witness evidence relevant to fault allocation.
  • Separate factual causation from legal allocation of negligence.
  • Apply current NRS 41.141 and controlling Nevada authority.
