Oklahoma UM/UIM Anti-Stacking & Multiple Insurance Policies

Oklahoma’s UM statute now expressly addresses stacking. Under 36 O.S. § 3636(B), policies issued, renewed or reinstated after November 1, 2014 are not subject to stacking or aggregation of UM limits unless the insurance carrier expressly provides for stacking.

  • Identify every potentially applicable policy and its issue, renewal or reinstatement date.
  • Review each policy for an express grant of stacking or aggregation.
  • Do not assume that multiple vehicles, policies or premiums automatically produce additive UM/UIM limits after the 2014 amendment.
  • Analyze insured status and policy priority separately from stacking.
