OREGON GUIDE 05

Oregon Uninsured & Underinsured Motorist Coverage

Oregon’s statutory motorist-protection system provides uninsured and underinsured motorist coverage under ORS 742.500–742.506. Coverage analysis should begin with the actual policy, insured status, applicable limits, offsets, settlement history and the governing statutory text.

  • Identify every policy that may provide UM/UIM protection.
  • Determine who qualifies as an insured under each policy.
  • Review liability settlements, offsets, exhaustion and subrogation issues.
  • Apply Oregon’s current statutory framework together with the actual contract language.
