South Dakota Stacking & Multiple Insurance Policies
South Dakota has express statutory restrictions on adding uninsured and underinsured motorist limits. SDCL 58-11-9.7 prevents adding an insured’s UM and UIM limits together for one accident, subject to the statute’s exception for separate uninsured and underinsured tortfeasors. SDCL 58-11-9.8 and related provisions restrict adding coverage limits for multiple insured vehicles.
- Identify every potentially applicable policy before deciding whether limits may be combined.
- Distinguish separate policies, separate vehicles and separate tortfeasors.
- Read the statutory anti-stacking provisions together with the actual policy language.
- Do not assume payment of multiple premiums automatically permits stacking.
