South Dakota Uninsured & Underinsured Motorist Coverage
South Dakota requires uninsured motorist coverage and requires underinsured motorist coverage to be provided with motor-vehicle liability policies, subject to statutory limits and policy terms. Under SDCL 58-11-9 and 58-11-9.4, UM and UIM generally track the bodily-injury liability limits, subject to the statutory $100,000 per person/$300,000 per accident ceiling unless additional coverage is requested.
- Obtain every declarations page and UM/UIM endorsement that may apply.
- Identify each insured person and vehicle before assuming coverage is limited to the occupied vehicle.
- Review anti-stacking statutes and policy provisions before combining limits from multiple vehicles or policies.
- Evaluate liability settlements, subrogation and release language before resolving the third-party claim.
