Florida Crash Investigation, Evidence Preservation & Limitations

Florida significantly shortened the general negligence limitations period in 2023. For negligence causes of action accruing after the statutory change, the general limitations period is two years. Older causes of action may be governed by prior law, and special claims—including governmental, wrongful-death and contractual claims—have different deadlines.

  • Determine the date the cause of action accrued before selecting a limitations period.
  • Calendar any sovereign-immunity presentment, wrongful-death, PIP, UM/UIM or contractual deadline separately.
  • Preserve vehicles, event-data recorder information, video, photographs, crash reports and witness evidence promptly.
  • Do not treat the general negligence period as a substitute for claim-specific limitations research.
