Florida UM/UIM Stacking, Nonstacking Elections & Multiple Policies
Florida UM/UIM stacking is governed by § 627.727 rather than the general anti-stacking statute. Florida permits an insured to elect nonstacking UM coverage under statutory conditions, while stacking coverage remains available when properly purchased.
- Obtain the UM selection form and determine whether stacking or nonstacking coverage was elected.
- Identify every insured vehicle and each separate policy potentially available to the injured person.
- Do not apply § 627.4132’s general anti-stacking rule to UM coverage; that statute expressly excludes UM, which is governed separately.
- Analyze insured status, vehicle involvement and policy priority before calculating available limits.
