Georgia Government Vehicle Crashes, Ante-Litem Notice & Liability Caps
Georgia government-vehicle claims require careful entity identification because state, county and municipal claims are governed by different immunity and ante-litem statutes. Under the Georgia Tort Claims Act, state claims generally require written notice within 12 months after the loss was or should have been discovered. Municipal tort claims generally require ante-litem notice within six months.
- Identify whether the defendant is the State, a state agency, county, municipality, authority or other public entity.
- For state claims, comply with O.C.G.A. § 50-21-26’s notice contents, recipients and timing.
- For municipal claims, comply with O.C.G.A. § 36-33-5’s six-month notice and demand requirements.
- Review waiver, immunity, liability caps and entity-specific limitations before suit.
