Kansas Uninsured & Underinsured Motorist Coverage
Kansas requires UM coverage equal to bodily-injury liability limits and includes UIM protection, subject to the named insured’s right to reject in writing coverage above the statutory 25/50 bodily-injury minimums. K.S.A. 40-284 also contains anti-stacking and UIM subrogation procedures.
- Obtain every declarations page and UM/UIM endorsement that may apply.
- Identify insured status under each potentially applicable policy.
- Review any written rejection of limits above the statutory minimum.
- Before accepting an underinsured tortfeasor’s liability limits, follow the statutory notice and subrogation procedure, including the insurer’s 60-day substitution period.
