Kentucky’s Motor Vehicle Reparations Act contains a special limitations rule for covered motor-vehicle tort claims. KRS 304.39-230(6) generally permits an action for tort liability not abolished by the Act within two years after injury, death, or the date of issuance of the last basic or added reparation payment, whichever is later, subject to the statute’s detailed rules.
- Determine whether the MVRA limitations provision applies to the claimant and claim.
- Track the date of the last qualifying BRB or added-reparation payment; replacement checks do not reset the date as specified by statute.
- Preserve vehicles, event-data recorder information, video, photographs, reports and witness evidence immediately.
- Calendar separate insurance, government and wrongful-death deadlines where applicable.
