Kentucky Government Vehicle Crashes, Board of Claims & Local Government Liability

Negligence claims against the Commonwealth and its agencies are generally within the exclusive jurisdiction of the Kentucky Board of Claims. Current statutory limits generally cap a single award at $250,000 and total awards arising from one negligent act at $400,000, with no claimant receiving more than $250,000.

  • Claims generally must be filed with the Board within one year after accrual under KRS 49.120.
  • Personal-injury accrual uses the statutory discovery rule but is subject to a two-year outside limit from the negligent act, except where another statutory rule applies.
