Kentucky UM/UIM Stacking & Multiple Insurance Policies
Kentucky stacking law distinguishes mandatory uninsured-motorist coverage from optional underinsured-motorist coverage. Kentucky decisions have protected stacking of separately purchased UM coverage in important circumstances, while UIM coverage may be subject to enforceable anti-stacking terms because UIM is optional and governed by its contract subject to KRS 304.39-320.
- Identify every separate premium, vehicle and policy providing UM or UIM coverage.
- Analyze UM and UIM stacking separately rather than assuming the same rule applies to both.
- For UIM, review anti-stacking language, insured classification and the reasonable-expectations doctrine under current Kentucky case law.
- Apply the 2024 UIM settlement-credit amendments when calculating ultimate recovery.
