Kentucky Uninsured & Underinsured Motorist Coverage

Kentucky requires uninsured-motorist bodily-injury coverage unless the named insured rejects it in writing. Underinsured-motorist coverage is governed separately by KRS 304.39-320 and is subject to statutory settlement, credit and policy rules.

  • Obtain the UM rejection, declarations page and UIM endorsements for every potentially applicable policy.
  • Under Kentucky’s 2024 amendments, the UIM insurer’s liability-credit treatment depends on the liability limits and amounts actually paid, including special treatment of reasonable multi-claimant pro rata settlements.
  • Identify household, employer and other policies under which the claimant may qualify as an insured.
  • Review settlement and subrogation requirements before releasing an underinsured driver.
