Louisiana MedPay, Medical Provider Privileges, Subrogation & Reimbursement
Medical-payments coverage in Louisiana is contractual first-party coverage and should be analyzed separately from liability damages, health insurance and provider privileges. Louisiana’s current past-medical-expense statute, R.S. 9:2800.27, expressly excludes benefits received through an automobile liability policy providing medical-payments coverage from that statute’s collateral-source limitations.
- Obtain the declarations page and MedPay endorsement and confirm the insured persons, limits and time requirements.
- Track all MedPay payments, health-insurance payments, outstanding provider balances and medical-provider privileges.
- Review subrogation and reimbursement claims before distributing settlement proceeds.
- Do not automatically apply R.S. 9:2800.27’s past-medical-expense limitations to automobile MedPay benefits.
