Louisiana UM/UIM Anti-Stacking & Multiple Insurance Policies
Louisiana R.S. 22:1295 limits aggregation of UM coverage. UM limits are not increased merely because multiple vehicles are insured under one policy or because multiple UM policies are otherwise available, subject to the statute’s limited excess-coverage rule for an injured person occupying a non-owned automobile.
- The UM coverage on the occupied vehicle is generally primary when the injured person is occupying a vehicle not owned by the injured person, resident spouse or resident relative.
- After exhaustion of that primary UM coverage, the injured occupant may recover as excess from other available UM coverage.
- The statute limits the excess layer to one coverage from one additional UM policy.
- Analyze ownership, residency, occupancy and insured status before applying the priority rule.
