MISSOURI GUIDE 06
Missouri Stacking & Multiple Insurance Policies
Missouri stacking analysis must distinguish uninsured motorist coverage from underinsured motorist coverage. Missouri public policy can require stacking of qualifying UM coverage despite limiting policy language, while UIM stacking depends more heavily on the wording of the policy and controlling appellate decisions.
- Identify every potentially applicable policy and vehicle.
- Separate mandatory UM from optional UIM coverage.
- Review anti-stacking, other-insurance and anti-duplication provisions.
- Apply current Missouri statutes and controlling appellate authority to each coverage separately.
