CNMI Pure Comparative Fault, Proportional Reduction & Multi-Party Allocation

The CNMI Uniform Comparative Fault Act provides that contributory fault attributable to a claimant diminishes compensatory damages in proportion to the claimant’s fault but does not bar recovery. This is a pure comparative-fault system rather than a 50% or 51% threshold system.

  • Claimant fault reduces damages proportionally.
  • Claimant fault does not create a complete recovery bar.
  • Multi-party allocation, contribution and settlement effects require separate analysis under the Uniform Comparative Fault Act.
