Ohio Government Vehicle Crashes, Political Subdivisions & Court of Claims
Ohio separates claims against political subdivisions from claims against the State. Political-subdivision liability is governed principally by Ohio Rev. Code Chapter 2744, including the motor-vehicle exception in § 2744.02. Claims against the State of Ohio are generally brought in the Ohio Court of Claims under a different statutory framework.
- Identify whether the defendant is the State, a county, municipality, township, school district or another political subdivision.
- For political subdivisions, determine whether the motor-vehicle exception and any statutory defenses apply.
- For state defendants, analyze Court of Claims jurisdiction and the applicable limitations period.
- Preserve vehicle, dispatch, video, maintenance and governmental records immediately.
