Oklahoma Government Vehicle Crashes, GTCA Notice, Denial & Liability Caps
Claims against Oklahoma governmental entities are governed by the Governmental Tort Claims Act. A claim against the State or a political subdivision generally must be presented within one year after the loss. A claim is deemed denied if it is not approved in full within 90 days, and suit generally must be commenced within 180 days after denial unless a valid written extension applies.
- Identify whether the defendant is the State or a political subdivision and serve the statutorily correct recipient.
- State claims are filed with the Office of the Risk Management Administrator; political-subdivision claims are filed with the clerk of the governing body.
- Calendar the one-year presentment, 90-day denial and 180-day suit periods separately.
- Review statutory exemptions and liability caps before valuing the claim.
