South Carolina government tort claims are governed by the South Carolina Tort Claims Act. Current law generally caps recovery at $300,000 for one person’s loss arising from a single occurrence and $600,000 in the aggregate for a single occurrence, subject to statutory exceptions and special categories.

- A verified claim procedure can extend the ordinary filing period; otherwise suit generally must be commenced within two years, while a properly filed verified claim may permit up to three years.
- Review immunity exceptions and statutory caps before valuing the claim.
- Preserve public records, vehicle data, dispatch records and video promptly.
