South Carolina Settlement, Release & UIM Settlement Rights

Settlement should come only after responsible parties, applicable liability coverage, UM/UIM rights, damages, reimbursement interests, and any workers’ compensation or other valid liens have been identified. South Carolina law also limits the use of insurer-consent requirements before settlement with an at-fault party in UIM claims.

  • Identify every person and entity being released.
  • Review general-release, indemnity, hold-harmless, confidentiality and attorney-fee provisions.
  • Confirm how settlement affects UM/UIM rights under § 38-77-160 and the policy.
  • Resolve reimbursement, subrogation and valid lien interests before distribution.
  • Preserve complete settlement, release and payment documentation.
