Utah Crash Damages, PIP Tort Threshold & Property Loss

Utah’s no-fault/PIP system limits when a person who has or is required to have PIP may recover general noneconomic damages from an automobile accident. Under Utah Code § 31A-22-309, the threshold is satisfied when the injured person sustains death, dismemberment, permanent disability or permanent impairment based on objective findings, permanent disfigurement, a bone fracture, or medical expenses exceeding $3,000. The statutory threshold does not apply to an uninsured-motorist claim.

  • Identify benefits paid or payable under PIP coverage.
  • Determine whether at least one statutory tort-threshold category is satisfied before claiming general noneconomic damages against a tortfeasor.
  • Document past and future medical expenses, wage loss and other economic damages separately from the noneconomic threshold.
  • Document objective findings, fractures, disfigurement, permanent impairment and other threshold evidence where applicable.
  • Address vehicle repair, total loss, loss of use and other property damage separately from bodily-injury PIP issues.
