Texas Crash Damages, Paid-or-Incurred Medical Expenses & Property Loss
Texas crash damages can include recoverable medical expenses, lost income and earning capacity, property loss, noneconomic damages and other proven losses. For medical and health-care expenses, Civil Practice and Remedies Code § 41.0105 limits recovery to amounts actually paid or incurred by or on behalf of the claimant.
- Maintain the full medical billing record, contractual adjustments, payments and amounts legally owed.
- Separate past medical expenses from future medical needs and other economic loss.
- Document wage loss, earning capacity, household impact and noneconomic loss independently.
- Analyze property damage, loss of use, diminished value and total-loss issues separately from bodily injury.
