Texas Uninsured & Underinsured Motorist Coverage
Texas Insurance Code chapter 1952 requires UM/UIM coverage in automobile liability policies unless a named insured rejects the coverage in writing. The coverage can address bodily injury and covered property damage caused by uninsured, underinsured and hit-and-run motorists, subject to policy terms and statutory requirements.
- Obtain the declarations page, UM/UIM endorsement and any written rejection.
- Identify all persons and vehicles qualifying for coverage under each potentially applicable policy.
- For UIM, compare legally recoverable damages with amounts recovered or recoverable from the underinsured motorist’s liability insurer, subject to policy limits.
- Review settlement, consent, subrogation, deductible and property-damage provisions before closing the liability claim.
