Maryland Auto Insurance & Crash Law
VictimsGuide’s Maryland library organizes the rules that matter after a serious motor-vehicle crash: required liability insurance, personal-injury protection, uninsured and underinsured motorist coverage, enhanced UIM, policy interpretation, claims handling, employer and commercial coverage, government claims, contributory negligence, damages, medical liens, settlement and controlling case authority.
Maryland rules to identify early
- Minimum liability: Maryland generally requires at least $30,000 per person and $60,000 per accident for bodily injury, plus $15,000 for property damage.
- PIP: Maryland policies generally include minimum personal-injury protection benefits unless properly waived as permitted by statute.
- UM/UIM: Maryland requires uninsured-motorist protection and permits enhanced underinsured-motorist coverage that can materially change the amount available after the liability limits are exhausted.
- Contributory negligence: Maryland remains a contributory-negligence jurisdiction, so claimant negligence can completely bar recovery in an ordinary negligence action.
- Government claims: state and local governmental claims require separate MTCA/LGTCA notice and immunity analysis.
Preserve the declarations and endorsements, PIP elections, UM/UIM forms, crash report, photographs, video and electronic vehicle data, and investigate household, employer, commercial, umbrella and excess coverage before executing a release.
