Alaska Comparative Fault & Crash Liability
Alaska uses a pure comparative-fault system. Fault may be allocated among responsible actors, and a claimant’s damages are reduced in proportion to the claimant’s share of fault rather than automatically barred.
- Identify every potentially responsible driver, owner, employer, public entity and other actor.
- Preserve physical, electronic and witness evidence relevant to allocation.
- Separate factual causation from legal allocation of fault.
