American Samoa rules to identify early

  • Compulsory insurance: an owner’s policy generally must provide at least $10,000 per person and $20,000 per accident for bodily injury or death, plus $5,000 for property damage.
  • Permissive users: compulsory coverage extends to the named insured and persons using the vehicle with express or implied permission, subject to territorial law and the policy.
  • Direct action: an injured person may sue a liability insurer directly within the terms and limits of the policy for a cause of action arising in American Samoa, even if the policy purports to prohibit direct action.
  • Comparative negligence: claimant negligence does not bar recovery; damages are reduced in proportion to the claimant’s fault.
  • Government claims: claims against the American Samoa Government require separate administrative presentation and sovereign-immunity analysis.
