Idaho recognizes a first-party insurance bad-faith tort

White v. Unigard Mutual Insurance Co., 112 Idaho 94, 730 P.2d 1014 (1986), recognizes an independent tort claim when an insurer breaches the duty of good faith owed to its insured. Later Idaho decisions distinguish that tort from an ordinary breach-of-contract claim.

Unfair-claims statutes and regulations are separate from the tort

Idaho Code title 41, chapter 13 and Department of Insurance rules regulate unfair insurance practices. Regulatory noncompliance can be relevant evidence, but the common-law bad-faith claim must still satisfy Idaho’s judicially recognized elements.

Claims-handling chronology

  • Track notice, investigation, requests and responses.
  • Preserve coverage letters, evaluations, offers and denials.
  • Identify the evidence available when each insurer decision was made.
  • Separate contract coverage issues from claims-handling conduct.
