Idaho limits general noneconomic damages by statute

Idaho Code § 6-1603 establishes a cap on noneconomic damages and adjusts that cap annually based on the state average weekly wage. The Idaho Industrial Commission’s current schedule sets the cap at $538,425.04 for causes of action arising on or after July 1, 2026 and before July 1, 2027.

The statutory cap does not replace category-by-category damages analysis. Economic losses, property damage, and statutory exceptions—including specified willful or reckless misconduct and felony conduct—must be analyzed separately.
