Iowa broadly preserves causes of action after death

Iowa Code § 611.20 provides that all causes of action survive and may be brought despite the death of the person entitled or liable. Fatal-crash analysis therefore includes the decedent's surviving claim together with family-loss damages authorized by other Iowa provisions.

Iowa statutes identify specific family-loss elements

Sections 613.15 and 613.15A authorize specified recovery for medical/hospital expense and for loss of services, support, companionship and society in qualifying claims involving spouses, parents and children. Preserve relationship, dependency, earning and family-services evidence.

Wrongful-death timing still requires independent limitations analysis

Ordinary personal-injury/death-related actions often implicate Iowa's two-year limitations framework, but the exact accrual, representative, estate and specialized-claim rules should be analyzed separately. Do not assume estate administration extends a filing deadline.

Coordinate the representative, estate and insurance before settlement

Identify the person authorized to prosecute the surviving/fatal claim, every liability and UM/UIM policy, statutory family-loss interests, liens and reimbursement claims before executing a global release.

Closing guidance

Treat an Iowa fatal crash as a coordinated survival/estate and family-loss matter. Confirm the proper representative, damages, coverage and deadlines before settlement.
