Pre-suit requests and litigation discovery are different routes

The reviewed Kansas authorities do not establish a universal Colorado-style pre-suit policy-limit disclosure statute. Before suit, request declarations, applicable forms, umbrella/excess information and written coverage positions voluntarily. Once litigation begins, K.S.A. 60-226(b)(3)(A) supplies a formal insurance-agreement discovery route.

K.S.A. 60-226 permits discovery of qualifying insurance agreements

A party may obtain the existence and contents of an insurance agreement under which an insurance business may satisfy, indemnify or reimburse a judgment. Disclosure does not itself make the agreement admissible, and the application is not treated as part of the insurance agreement for this provision.

Kansas claims-practice rules support specific written coverage explanations

K.S.A. 40-2404 identifies unfair claims settlement practices including misrepresentation, unreasonable delay in communications/investigation, unreasonable refusal to pay, failure to attempt fair settlement when liability is reasonably clear, and failure to explain denials or compromise offers. These regulatory duties support disciplined written requests but do not themselves create universal pre-suit policy production.

Keep a disclosure and missing-document log

Record every request, delivery date, recipient, response and document received. Distinguish declarations, complete policy forms, endorsements and umbrella/excess agreements from claim-file materials that may raise separate discovery issues. If only a limit or summary is supplied, request the provision supporting any disputed exclusion, priority or insured-status position.
