Kansas Government Vehicle Crashes & Public Entity Claims
Kansas government-vehicle claims can be governed by the Kansas Tort Claims Act and special pre-suit notice procedures. Claims against municipalities require careful review of K.S.A. 12-105b before filing suit.
- Identify the governmental entity and the employee’s agency or municipality.
- For municipal claims, K.S.A. 12-105b requires written notice containing specified claimant, factual, injury and damages information.
- After notice, suit generally may not begin until the claim is denied or 120 days passes; the statute also preserves at least 90 days to commence suit after denial or deemed denial.
- Preserve vehicle, dispatch, body-camera, maintenance and governmental records immediately.
