Kansas Work, Employer & Commercial Vehicle Coverage

Identify the employer, vehicle owner and business purpose of the trip
Record the driver’s employer, job duties, destination, dispatch/customer instructions, vehicle owner/lessee and any contractor relationship. Preserve timekeeping, route, reimbursement, dispatch and business communications. Employment alone does not establish that the driver was acting within the scope of employment at the time of the crash.
Scope of employment and direct employer negligence are different theories
Kansas respondeat superior requires the employee to be acting within the scope of employment. Marquis confirms that negligent entrustment, hiring, retention and supervision are analytically distinct direct-negligence theories and are not automatically erased merely because the employer admits scope for respondeat-superior purposes.
Commercial insurance must be traced independently from tort liability
Investigate commercial auto, hired/non-owned auto, employer umbrella/excess and the driver’s personal policy. Read named-insured and covered-auto designations. An employer can be liable without every commercial policy necessarily applying, while a commercial policy’s existence does not itself establish scope of employment.
Preserve fleet, qualification and trip evidence early
Identify telematics, EDR, dash-camera video, dispatch logs, maintenance records, driver qualification/training materials and relevant business communications. Tie each preservation request to a specific issue such as scope, route, speed, maintenance, entrustment or ownership rather than seeking an undifferentiated employment file.
