Classify the vehicle as ordinary borrowed, temporary substitute or rental before assigning coverage

Louisiana has specific statutory rules for temporary substitutes, rentals and other non-owned vehicles. Preserve ownership, permission, rental agreement, whether the vehicle was regularly available, and every owner/driver policy. Do not rely on the slogan 'insurance follows the car' because Louisiana statutes can shift or layer priority depending on the vehicle relationship.

The insured's existing coverage generally extends to a qualifying rental and is primary

R.S. 22:1296 requires qualifying automobile liability, physical-damage or collision coverage in the original policy to extend to temporary substitutes and rental vehicles. That extension is generally primary. If the insured separately purchases automobile insurance or financial-responsibility protection for the rental, the purchased rental coverage becomes primary instead.

Other non-owned vehicles receive secondary protection when statutory conditions are met

R.S. 22:1296.1 bars exclusion of liability, UM/UIM or MedPay benefits for an insured operating a non-owned vehicle when coverage is in force, the owner gave express or implied permission and the vehicle is not regularly furnished or available to the insured. That coverage is generally secondary to the owner's policy, subject to the rental/substitute rule in §1296.

Keep liability, UM/UIM, physical damage and rental products in separate columns

A rental collision/loss-damage waiver is not the same protection as liability insurance. Optional rental insurance can alter priority under §1296. UM/UIM still follows §22:1295's election, insured-status and anti-stacking rules. Obtain every contract and ask each carrier to identify the precise priority provision rather than assuming one payment source resolves all coverages.

Closing guidance

Louisiana gives rentals and qualifying non-owned vehicles explicit statutory treatment. Classify the vehicle relationship, prove permission/regular use, and then map liability, UM/UIM and physical-damage priority separately.
