Michigan Borrowed, Non-Owned & Rental Vehicles
Borrowed and rental vehicles can create overlapping Michigan questions involving owner liability, permissive use, policy definitions, PIP priority, rental agreements, and federal limits on vicarious liability against qualifying rental owners.

Non-Owned Vehicles
Separate tort ownership from insurance coverage
A vehicle owner’s potential tort liability, the driver’s liability coverage, the renter’s contract, and the injured person’s PIP source are separate legal questions that can point to different insurers.
Michigan owner liability
MCL 257.401 imposes owner liability for qualifying negligent operation by a person using a motor vehicle with the owner’s express or implied consent, subject to statutory terms and exceptions. Permission should be investigated factually rather than assumed from possession of the keys.
Rental companies and the Graves Amendment
For qualifying rental and leasing companies, 49 U.S.C. § 30106 generally preempts vicarious liability based solely on ownership. The federal statute preserves claims based on the rental owner’s own negligence or criminal wrongdoing and does not decide the renter’s liability, insurance priority, or every state financial-responsibility issue.
Read every potentially applicable policy
The driver’s personal policy may contain non-owned-auto coverage, exclusions, or excess provisions. The vehicle owner’s policy may insure permissive users. A rental agreement may offer or reject optional products. Michigan PIP benefits follow the No-Fault Act’s statutory priority rules rather than the simple question of who owned the vehicle.
Evidence to collect
- Title, registration, and ownership records.
- Permission communications and key-transfer facts.
- Rental or loaner agreement and all optional insurance selections.
- Driver’s personal policy and owner’s policy.
- Employer or commercial policies if the use was work-related.
- Any representations supporting or disputing rescission or excluded-driver defenses.
