Automobile insurance law is state specific. Montana combines compulsory liability insurance, statutorily required uninsured-motorist coverage unless rejected, optional underinsured-motorist coverage, modified comparative negligence, important statutory insurer-conduct remedies, and a developed body of stacking and made-whole law.

Montana’s 23 published guides were completed under the first-generation Western States sequence. They remain the authoritative Montana navigation system, and their existing URLs are preserved.

California and Colorado later established the canonical production sequence used for new state libraries. The legal questions remain comparable across states, but several guide numbers differ.

Montana’s ordinary minimum motor-vehicle liability limits under MCA §§ 61-6-103 and 61-6-301.

Montana’s UM statute does not itself mandate UIM coverage. The policy and controlling cases therefore matter independently.

What is distinctive about Montana?

Several Montana doctrines materially affect automobile-insurance investigation, claim handling and net recovery.

Direct statutory UTPA remedy

MCA § 33-18-242 permits insureds and qualifying third-party claimants to bring an independent action for specified violations of MCA § 33-18-201. Montana therefore has a particularly important statutory insurer-conduct system.

UM required; UIM optional

Montana requires uninsured-motorist coverage unless rejected by the named insured. Underinsured-motorist coverage is not mandated by the same statute and depends more heavily on the policy and Montana cases.

Developed made-whole doctrine

Montana has substantial made-whole and subrogation authority. The analysis requires attention to the covered loss, the actual recovery, costs of obtaining that recovery and the particular category of damage involved.
