New Mexico Auto Insurance & Crash Law
VictimsGuide’s New Mexico library organizes the rules that matter after a motor-vehicle crash: compulsory liability insurance, uninsured and underinsured motorist coverage, permissive use, claims handling, employer and commercial coverage, government claims, comparative negligence, damages, settlement and case authority.
New Mexico rules to identify early
- Minimum liability: New Mexico’s ordinary minimum liability limits are 25/50/10.
- UM/UIM: uninsured and underinsured motorist protection is governed by statutory offer/rejection requirements and New Mexico appellate law concerning valid rejection and policy limits.
- Comparative negligence: New Mexico follows pure comparative negligence, reducing damages in proportion to claimant fault rather than imposing a 50% or 51% bar.
- Government claims: crashes involving governmental entities require separate Tort Claims Act, notice and immunity analysis.
Preserve the complete policy, UM/UIM election or rejection forms, crash report, photographs, video and electronic evidence, and investigate employer, commercial, umbrella and excess coverage before executing a release.
