North Carolina Government Vehicle Crashes, State Tort Claims & Local Immunity

Negligence claims against North Carolina State departments and agencies are generally heard by the North Carolina Industrial Commission under the State Tort Claims Act. State tort claims generally must be filed with the Commission within three years after accrual; wrongful-death claims must generally be filed within two years after death.

  • Identify whether the vehicle is operated by the State, a county, municipality, school board or other public entity.
  • State-agency claims belong in the Industrial Commission rather than ordinary superior court.
  • Contributory negligence remains an express defense under the State Tort Claims Act.
  • Local-government immunity and insurance-waiver rules must be analyzed separately from State claims.
